I almost bought this

I almost bought this menu sign thinking that it featured a Wacky Package value meal of some sort!
A no name fast food restaurant - anyone recognize this? No pictures of actual Wackys so I passed on this - but it would have gone well with my diner banquette set...

Interesting story: My brother is an intellectual property attorney, and he knows I'm interested in anything Wackys related. He has done searches for legal cases and decisions regarding Topps and Wackys for me. He saw the same Sonic menu and did some research on the topic. Turns out Sonic registered "Wacky Packs" as a trademark in 1998, and Topps' trademark in the name was cancelled in 2015! Topps needed to file a Declaration of Use to maintain its interest in the name, but it wasn't done. The good news is that "Wacky Packages" (as opposed to "Packs") is still completely protected! Crazy, huh? - Pete

Items like this sometime seem so arbitrary and odd. I wonder how finely you can slice up "Wacky Packages" and keep getting unique trademarks. I'll see if I can get "WACKY PACKAS" for my new line...

I wonder if Sonic can sue Everything but the House for referring to them as "Wacky Packs" in their TV show.

Not really. "Wacky Packs" was always a slang, abbreviated term for them (except in the UK) and not their official name. I'm surprised to hear Topps ever protected the name at all (maybe due to the official use of it in the UK).

Not crazy at all, I am absolutely certain Topps has blown it with protecting much about wackys, they don't seem to care at all that wacky packages images are used for all sorts of profitable knock off sets.

Yup, Topps has allowed blatantly obvious use of their images for profitable ventures.  The precedence is clear.
